These Terms of Use govern your use of TheEditor (the "App"), an iOS / iPadOS application published by Tom Bode (the "Developer", "we", "us"), based in the Netherlands. By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.
The App is also subject to Apple's Standard EULA for Apps. Where these Terms are silent, Apple's Standard EULA applies. Where the two conflict, the more restrictive provision applies.
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions. You may not redistribute, reverse-engineer, decompile, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by applicable law.
Some features of the App ("Pro features") require an auto-renewing paid subscription ("TheEditor Pro"). The free portion of the App remains usable without a subscription.
You agree to use the App only for lawful purposes and not to:
The App processes the photos, metadata, FTP credentials and any related content you import or enter ("Your Content") entirely on your device or via your own iCloud account. We do not host, store, transmit, scan, or analyse Your Content on our servers — there are no servers operated by us. You retain all rights to Your Content. See the Privacy Policy for details.
You are solely responsible for Your Content, including ensuring you have the rights and consents necessary to process, edit, tag, and export it (including face data, where applicable).
The App, including its source code, design, logos, icons, and trademarks ("the.editor", the red-square / mark, and TheEditor wordmark), is owned by the Developer or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right or license in our intellectual property, except for the limited license to use the App in Section 1.
The App relies on Apple platform services (App Store, StoreKit, iCloud / CloudKit, Vision framework, Photos library, Files), each governed by Apple's own terms. The App may also connect to third-party FTP servers, e-mail services, or other endpoints that you configure — those endpoints are governed by their own terms, and the Developer is not responsible for them.
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that data will not be lost. You are responsible for backing up Your Content.
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, photos, metadata, profits, or business, arising out of or in connection with your use of the App. In any event, our aggregate liability under these Terms shall not exceed the amount you paid to Apple for the App in the twelve (12) months preceding the event giving rise to the claim, or EUR 50, whichever is greater.
Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence, or any liability that cannot be excluded under applicable law (including consumer rights under EU and Dutch law).
We may update the App and these Terms from time to time. Material changes to these Terms will be announced in-app and on this page with an updated date. Your continued use of the App after the change constitutes acceptance of the updated Terms. If you do not accept the change, stop using the App and cancel any active subscription.
You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to Pro features if you materially breach these Terms. Termination of these Terms does not affect any rights or obligations that by their nature survive termination (intellectual property, disclaimer of warranties, limitation of liability, governing law).
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms shall be submitted to the competent courts of the Netherlands. EU consumers retain the protections afforded by the mandatory consumer-protection laws of their country of habitual residence; nothing in these Terms limits those rights.
Questions about these Terms — including subscription, billing, or licensing matters — can be sent to tom@tombode.nl.
